Your privacy matters to us. This policy explains what data we collect, how we use it, and your rights — including how our AI features (current and future) handle your content.

1. Who We Are

You Stay Forever (“we”, “us”, “our”) operates the memorial platform at youstayforever.com. You can contact us at hello@youstayforever.com for any privacy-related questions.

2. Information We Collect

2.1 Information You Provide

When you use our Service, we may collect:

  • Email address (required to create a memorial)
  • Name of the deceased, dates of birth and death, biographical text
  • Photographs and other media you upload
  • Tribute messages submitted by visitors
  • Payment information (processed securely by our payment provider; we do not store full card details)

2.2 Information Collected Automatically

We automatically collect certain technical information when you use our Service:

  • IP address and general location (country/region)
  • Browser type and device information
  • Pages visited, time spent, and referring URLs
  • Cookies and similar tracking technologies (see Section 7)

2.3 AI Features — Current and Future

You Stay Forever may offer AI-powered features, including but not limited to photo enhancement, animated memorial videos, and AI-generated tributes. When you use these features:

  • Photographs and media you submit may be processed by third-party AI service providers (e.g., image animation APIs) solely to deliver the requested output.
  • We do not use your photos or personal content to train AI models without your explicit, separate consent.
  • Third-party AI providers are contractually required to process your data only for the purpose of delivering the feature and not to retain or reuse it.
  • We will update this Privacy Policy and notify you before introducing any new AI features that involve additional data processing.

3. How We Use Your Information

We use the information we collect to:

  • Create, host, and display memorial pages
  • Send you transactional emails (e.g., memorial creation confirmation, anniversary reminders if enabled)
  • Process payments for Premium plans
  • Provide customer support
  • Improve the Service and diagnose technical issues
  • Comply with applicable laws and legal obligations
  • Deliver AI-powered features you have explicitly requested

We do not use your personal data for targeted advertising.

4. How We Share Your Information

4.1 We Do Not Sell Your Data

We do not sell, rent, or trade your personal information to third parties for their marketing purposes.

4.2 Service Providers

We share data with trusted third-party service providers who assist us in operating the Service, including:

  • Cloud hosting and storage (e.g., Supabase)
  • Email delivery (e.g., Resend)
  • Payment processing (e.g., Stripe)
  • AI processing providers for optional AI features
  • Analytics tools (e.g., Vercel Analytics)

All service providers are bound by confidentiality obligations and are prohibited from using your data for any purpose other than providing services to us.

4.3 Legal Requirements

We may disclose your information if required by law, court order, or government authority, or if we believe disclosure is necessary to protect the rights, property, or safety of You Stay Forever, our users, or the public.

4.4 Business Transfers

In the event of a merger, acquisition, or sale of all or part of our assets, your information may be transferred to the acquiring entity. We will notify you via email and/or a notice on our website before your data is transferred and becomes subject to a different privacy policy.

5. Memorial Pages & Public Content

Memorial pages set to “public” are visible to anyone on the internet, including search engines. Tribute messages submitted by visitors are also public by default. You are responsible for the privacy settings of your memorial page. We do not currently offer private memorial pages in the Free tier; this feature may be available in Premium plans.

6. Data Retention

We retain your data for as long as your account and memorial pages are active. If you request deletion of your account, we will delete your personal data and memorial content within 30 days, except where we are required to retain it by law (e.g., billing records).

In the event we discontinue the Service, we will provide at least 90 days' notice and a data export option as described in our Terms of Service.

7. Cookies

We use cookies and similar technologies to:

  • Keep you logged in
  • Remember your preferences
  • Analyze usage of the Service

You can control cookies through your browser settings. Disabling cookies may affect some functionality of the Service.

8. Children's Privacy

Our Service is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at hello@youstayforever.com and we will delete it promptly.

9. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Request correction of inaccurate or incomplete data.
  • Deletion: Request deletion of your personal data ('right to be forgotten').
  • Portability: Request your data in a machine-readable format.
  • Objection: Object to certain types of processing, including automated decision-making.
  • Withdraw Consent: Where processing is based on consent, you may withdraw it at any time.

10. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

  • The right to know what personal information we collect, use, disclose, and sell.
  • The right to delete personal information we have collected from you.
  • The right to opt out of the sale of personal information. (We do not sell personal information.)
  • The right to non-discrimination for exercising your CCPA rights.

11. International Users

You Stay Forever is operated from the United States. If you are accessing the Service from outside the United States, please be aware that your information may be transferred to and processed in the United States, where data protection laws may differ from those in your country. By using the Service, you consent to this transfer.

12. Security

We implement industry-standard security measures to protect your personal data, including encryption in transit (HTTPS/TLS) and at rest. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

13. Third-Party Links

Our Service may contain links to third-party websites. We are not responsible for the privacy practices of those websites. We encourage you to read their privacy policies before providing any personal information.

14. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via email and/or a notice on our website at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated policy.
